This End User License Agreement (“EULA”) is a legal agreement between you, either an individual or an entity (“Licensee”, “you”, or “your”), and DevJet Software (“DevJet Software”, “DevJet”, “we”, “us”, or “our”) regarding your use of the software product known as DocInsight, formerly known as Documentation Insight (the “Product”).
DevJet Software is a business name used by an independent software developer and vendor. Unless an order, invoice, written agreement, or updated legal notice identifies a separate or successor legal entity, references to “DevJet Software”, “DevJet”, “we”, “us”, or “our” mean the individual operator using that business name.
By installing, activating, accessing, or using the Product, you agree to be bound by this EULA. If you do not agree to this EULA, do not install, activate, access, or use the Product.
1. Definitions
For purposes of this EULA:
- “Product” means DocInsight, including the desktop application, command-line tools, build tools, extensions, documentation, templates, themes, managed toolchains, and any related software components provided by DevJet Software.
- “DevJet Software” means the independent software developer and vendor operating under the business name DevJet Software, or any successor or operating legal entity expressly identified in an order, invoice, written agreement, or updated legal notice.
- “Licensee” means the individual or legal entity that accepts this EULA or purchases, receives, activates, or uses a license for the Product.
- “Authorized User” means an individual developer or user who is assigned a valid license seat and is permitted to use the Product under this EULA.
- “Subscription” means a paid DocInsight subscription for the subscription term stated in the applicable order, such as a one-year or two-year subscription.
- “Subscription Term” means the period during which a Subscription is active.
- “Legacy Personal License” means an existing active personal license or personal subscription issued before DevJet Software discontinued new Personal License sales.
- “Trial License” means a temporary evaluation license issued for trial or evaluation purposes.
- “Donation License” means a license issued without charge, or at a special promotional or donated rate, including licenses issued for community, MVP, open source, educational, or similar donation programs.
- “Customer Code” means source code, documentation source files, project files, build files, API metadata, comments, examples, and other materials owned, controlled, maintained, developed, or lawfully processed by Licensee.
- “Documentation Output” means documentation, websites, HTML files, CHM files, PDF files, search indexes, metadata, or other output generated by the Product.
- “Permitted Project” means a software or documentation project that Licensee owns, controls, maintains, develops, or is otherwise legally authorized to process and document.
2. License Grant
Subject to payment of applicable fees and compliance with this EULA, DevJet Software grants Licensee a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Product solely in accordance with this EULA and the applicable license type.
All rights not expressly granted to Licensee are reserved by DevJet Software.
The Product is licensed, not sold. DevJet Software retains all rights, title, and interest in and to the Product, including all intellectual property rights.
3. Current Paid License: DocInsight Subscription
3.1 Current Offering
DevJet Software currently offers the Product as a DocInsight Subscription. A DocInsight Subscription may be offered as a one-year subscription, two-year subscription, or another subscription term stated at the time of purchase.
Unless otherwise stated in the applicable order, a paid DocInsight Subscription may be used for both commercial and non-commercial purposes.
3.2 Named User Licensing
Each Authorized User who uses the Product must have an assigned license seat. License seats may not be shared, pooled, or used concurrently by multiple individuals.
An Authorized User may install and activate the Product on a reasonable number of devices used by that same Authorized User, provided that the license is not used by any other person. A reasonable number of devices means devices primarily used by the same Authorized User for development, documentation, testing, build, or CI-related work, and does not permit shared interactive use by multiple unlicensed individuals.
For entity purchases, licenses are owned and controlled by the purchasing entity and may be assigned to individual Authorized Users. A license may be reassigned to another individual only in connection with a genuine change in role, employment, project assignment, or similar business need. License reassignment may not be used as a substitute for purchasing sufficient license seats.
For individual purchases, the license is assigned to the individual purchaser and may not be transferred, shared, resold, sublicensed, or reassigned to another individual or entity.
3.3 Covered Versions and Continued Use
During an active Subscription Term, Licensee may use Product versions released during that Subscription Term and may receive updates, fixes, and new versions made generally available by DevJet Software for the applicable license.
After a paid Subscription expires or is cancelled, Licensee may continue using Product versions that were released during the active Subscription Term, provided that Licensee remains in compliance with this EULA. DevJet Software may require license validation to verify that the applicable Product version was released during Licensee’s active paid Subscription Term, but expiration or cancellation alone does not require Licensee to renew solely to continue using eligible previously released Product versions.
Access to future versions, updates, new features, support, online services, new managed toolchain downloads, or Product functionality that depends on DevJet Software servers may require an active Subscription. Discontinued infrastructure, discontinued third-party dependencies, security requirements, or technical changes may affect the availability of online activation, update, or download services for older versions.
4. Legacy Personal Licenses
DevJet Software no longer offers new Personal Licenses as a current license type.
Existing active Legacy Personal Licenses may continue to renew under the legacy renewal terms made available by DevJet Software, subject to continued availability and compliance with this EULA.
A Legacy Personal License:
- may be used only by the original individual licensee;
- may not be transferred, assigned, sold, rented, leased, sublicensed, or shared;
- may not be owned, reimbursed, controlled, or managed by an employer, client, company, or other organization;
- may not be reassigned to another person; and
- may not be converted into an organizational license except as expressly permitted by DevJet Software.
If a Legacy Personal License expires, lapses, is cancelled, refunded, terminated, or otherwise becomes inactive, DevJet Software is not obligated to offer a new Personal License or reinstate the legacy license. In that case, Licensee may be required to purchase a current DocInsight Subscription.
Existing commercial licenses or commercial subscriptions may be renewed, migrated, or treated as DocInsight Subscriptions according to the renewal or migration terms made available by DevJet Software.
5. Trial Licenses
A Trial License is provided solely for evaluation purposes.
A Trial License may be used to generate Documentation Output solely for internal evaluation. Unless expressly permitted by DevJet Software in writing, Documentation Output generated using a Trial License may not be publicly distributed, published, sold, delivered to customers, used in production, used for paid services, or used for commercial release.
After the trial period expires, access to the Product, certain features, build targets, output generation, updates, or license services may be restricted.
Trial Licenses may not be used to provide services to third parties, to generate production documentation, or to avoid purchasing a paid Subscription.
6. Donation Licenses and Non-Commercial Use
A Donation License is provided for limited use under a community, MVP, open source, educational, promotional, or similar donation program.
Unless the applicable written license terms expressly state otherwise, a Donation License is limited to non-commercial use only.
Non-commercial use may include use for personal learning, community projects, public open source projects, educational demonstrations, non-commercial documentation, or other non-commercial activities approved by DevJet Software.
A Donation License may not be used:
- for commercial software development;
- for proprietary internal company projects;
- for paid consulting work;
- for work performed for an employer or client;
- to generate documentation for a commercial product or service;
- to provide documentation generation, documentation hosting, build automation, or related services to third parties;
- as part of a service bureau, SaaS, managed service, hosted build service, outsourced documentation service, or documentation generation service; or
- for any purpose outside the donation program for which the license was issued.
Documentation Output generated under a Donation License may be published or redistributed only for the same non-commercial project or purpose for which the Donation License was issued, unless DevJet Software gives written permission otherwise.
Donation Licenses do not include any guaranteed support, upgrade, renewal, transfer, resale, or perpetual use rights unless expressly stated by DevJet Software in writing.
7. Permitted Projects and Customer Code
Licensee may use the Product only with Customer Code and Permitted Projects.
Licensee is responsible for ensuring that it has all necessary rights, permissions, and licenses to process, analyze, build, document, publish, and distribute documentation for the applicable source code, project files, comments, API metadata, third-party dependencies, and related materials.
Use of the Product does not grant Licensee any rights in third-party source code, third-party documentation, third-party APIs, third-party comments, SDKs, libraries, frameworks, or other third-party materials.
Licensee may not use the Product to generate or publish documentation for source code, APIs, libraries, SDKs, frameworks, or other materials that Licensee does not own, control, maintain, develop, or have legal authorization to document.
Licensee may not use a DocInsight license to offer a standalone documentation generation service, hosted documentation build service, outsourced documentation service, documentation-as-a-service offering, service bureau, SaaS offering, public API, or similar service for third parties without a separate written agreement with DevJet Software.
This restriction does not prohibit ordinary internal use by Licensee on projects that Licensee owns, controls, maintains, develops, or is legally authorized to document in the ordinary course of its own business.
This restriction also does not prohibit a licensed consultant or contractor from using the Product as part of ordinary software development or documentation work for a client, provided that the consultant or contractor is legally authorized to process the client materials, does not make the Product available to the client or other third parties, and does not offer the Product itself as a hosted, automated, self-service, or standalone documentation generation service.
For entity Licensees, Licensee will be responsible for claims arising from Licensee’s Customer Code, Documentation Output, unauthorized use of third-party materials, or violation of applicable laws or third-party rights, except to the extent caused by DevJet Software’s breach of this EULA.
8. Command-Line Interface, Build Servers, and CI Use
Licensee may install the DocInsight command-line interface and related build tools on a build server, continuous integration server, or automation environment solely for automated documentation generation for Permitted Projects.
Such CI or build server use is permitted only if:
- the build server is controlled by Licensee or operated on Licensee’s behalf;
- access to the Product, license keys, activation files, credentials, and generated output is reasonably restricted;
- the Product is not made available for interactive use by unlicensed users;
- the Product is not exposed as a hosted service, public API, SaaS service, or documentation generation service; and
- the CI or build environment is used only for projects that Licensee is permitted to process under this EULA.
The Product, including the CLI, runtime components, license files, activation files, managed toolchains, and extensions, is not a redistributable component and may not be distributed to third parties except as expressly permitted by DevJet Software in writing.
9. Documentation Output
Subject to this EULA and any applicable third-party rights, Licensee owns its Documentation Output.
A paid Licensee may publish, host, copy, and redistribute Documentation Output generated using a valid paid DocInsight Subscription, provided that:
- the Documentation Output was generated for a Permitted Project;
- Licensee has the necessary rights to publish the underlying content;
- the Documentation Output does not include unauthorized third-party materials; and
- Licensee complies with this EULA and all applicable laws and third-party license terms.
DevJet Software claims no ownership of Licensee’s Customer Code or Documentation Output.
Licensee acknowledges that Documentation Output may contain or reflect source code comments, API structures, identifiers, descriptions, examples, metadata, file paths, project structure, dependency information, or other materials from Licensee’s source projects. Licensee is solely responsible for reviewing Documentation Output before publishing, hosting, copying, distributing, or otherwise making it available.
10. Restrictions
Licensee shall not, and shall not permit any third party to:
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, internal structure, algorithms, license mechanisms, or activation mechanisms of the Product, except to the extent such restriction is prohibited by applicable law;
- modify, adapt, translate, or create derivative works based on the Product;
- remove, alter, obscure, or bypass any license notice, activation mechanism, copyright notice, attribution, watermark, or proprietary notice in the Product;
- rent, lease, lend, sell, resell, sublicense, assign, distribute, publish, transfer, or otherwise make the Product available to any third party;
- share license keys, activation files, credentials, accounts, or subscription access with unauthorized users;
- use the Product to provide a service bureau, SaaS, hosted build service, documentation generation service, documentation-as-a-service offering, outsourced documentation service, or similar service to third parties;
- use the Product with code, projects, documentation, APIs, SDKs, libraries, frameworks, or other materials that Licensee is not authorized to process or document;
- use a Trial License or Donation License for production, commercial, client, employer, or revenue-generating work unless expressly permitted by DevJet Software in writing;
- circumvent license limits, seat limits, activation limits, trial limits, technical restrictions, or usage restrictions;
- use the Product in violation of applicable law or third-party rights;
- use, download, export, re-export, or transfer the Product in violation of applicable export controls, sanctions, or trade restrictions; or
- use the Product in a manner that could damage, disable, overburden, impair, or interfere with DevJet Software systems, license services, update services, or other users.
11. Network Features, Updates, and License Compliance
The Product may connect to DevJet Software servers, FastSpring services, or other service providers for license activation, license validation, subscription status checks, update checks, update downloads, managed toolchain downloads, support diagnostics if provided by Licensee, and other Product-related services.
Licensee agrees that DevJet Software may use network-based checks to verify license validity and compliance with this EULA.
Blocking, disabling, or interfering with license validation, activation, subscription status checks, update services, or managed toolchain services may prevent the Product from activating, updating, downloading components, or functioning correctly.
The Product is designed primarily as local software. Customer Code and local documentation source files are not intentionally uploaded to DevJet Software solely for license validation, update checks, or subscription status checks.
However, Licensee is responsible for reviewing any files, logs, diagnostic reports, crash dumps, screenshots, sample projects, or support materials before sending them to DevJet Software, because such materials may contain source code, documentation content, file paths, identifiers, credentials, confidential information, or other sensitive information.
If Licensee enables debug logging, local log files may include source code, documentation content, project structure, file paths, command-line arguments, environment details, identifiers, or other sensitive information. Licensee is responsible for protecting, reviewing, redacting, and deleting such logs as appropriate.
12. Orders, Payments, Renewals, and Refunds
Orders, payments, taxes, invoices, renewals, payment methods, cancellation workflows, and refunds may be processed by DevJet Software’s authorized reseller, merchant of record, payment processor, or e-commerce provider, including FastSpring.
Additional checkout terms, store terms, reseller terms, payment terms, tax terms, refund terms, and renewal terms may be presented at the time of purchase. Those terms apply to the purchase transaction in addition to this EULA.
12.1 Pricing
Initial purchase prices, renewal prices, upgrade prices, discounts, subscription terms, and available plans are subject to change. Current pricing and available plans are stated on DevJet Software’s official website or checkout page.
12.2 Manual and Automatic Renewal
Subscriptions may be offered with manual renewal, automatic renewal, or both.
For manual renewal, Licensee must renew before the Subscription expires to continue receiving updates, support, and access to Subscription-only features.
For automatic renewal, the Subscription will renew automatically at the end of the Subscription Term unless cancelled according to the applicable checkout or subscription management process. When automatic renewal is offered, the renewal term, renewal price, renewal date or billing cycle, and cancellation method should be disclosed at checkout or in the applicable subscription management process. Where required by applicable law, renewal reminders or other notices will be provided before automatic renewal.
12.3 Cancellation
Licensee may cancel automatic renewal according to the applicable subscription management process.
Cancellation stops future renewal charges but does not automatically refund amounts already paid unless required by applicable law, stated at checkout, or approved under DevJet Software’s refund policy.
After cancellation or expiration, Licensee may continue to use only the Product versions released during the active paid Subscription Term, subject to this EULA. Access to future updates, new versions, new features, managed toolchains, and support may cease.
12.4 Money-Back Guarantee
For initial paid purchases, DevJet Software may offer a 30-day money-back guarantee as stated on its website or checkout page.
Unless otherwise stated at checkout or required by applicable law, the money-back guarantee applies only to the initial purchase of a paid Subscription and does not automatically apply to renewals, reinstatements, migrations, discounted licenses, Donation Licenses, or Trial Licenses.
DevJet Software may deny a refund request if Licensee has violated this EULA, abused the refund policy, used the Product to provide services to third parties, generated production documentation contrary to the applicable license type, or otherwise exceeded the permitted use of the Product.
13. Support and Updates
Active paid Subscriptions may include access to updates and support made generally available by DevJet Software for the applicable Product and license type.
Support is provided at DevJet Software’s discretion and may vary by license type, Product version, platform, channel, subscription status, and support availability.
DevJet Software is not obligated to provide support, updates, compatibility fixes, managed toolchains, or new versions for expired Subscriptions, cancelled Subscriptions, Trial Licenses, Donation Licenses, unsupported platforms, discontinued versions, modified environments, or versions released outside Licensee’s active Subscription Term.
14. Third-Party Components
The Product may include, depend on, download, or interoperate with third-party software, libraries, tools, frameworks, SDKs, or components. Such third-party components may be subject to separate license terms.
Licensee is responsible for complying with all applicable third-party license terms.
Nothing in this EULA grants Licensee rights to third-party software, source code, SDKs, documentation, trademarks, or other third-party materials except as expressly provided by their respective owners.
15. Intellectual Property
DevJet Software owns all rights, title, and interest in and to the Product, including all copyrights, trademarks, trade secrets, software code, designs, documentation, user interfaces, templates, themes, build logic, license systems, and other intellectual property associated with the Product.
Licensee shall not remove, alter, or obscure any copyright, trademark, attribution, license, or proprietary notice contained in the Product.
All trademarks, product names, company names, and logos not owned by DevJet Software are the property of their respective owners.
16. Marketing and Public References
DevJet Software may identify Licensee as a customer only with Licensee’s permission, unless Licensee has already publicly identified itself as a DocInsight customer or has published public Documentation Output that identifies DocInsight as the generator.
DevJet Software may reference public open source projects, public showcases, public documentation websites, or public Documentation Output generated with DocInsight, provided that DevJet Software does not imply endorsement, sponsorship, affiliation, or partnership without permission.
DevJet Software will not use Licensee’s logo in marketing materials without permission.
Licensee may opt out of public customer references by contacting DevJet Software.
17. Non-Excludable Rights
Nothing in this EULA excludes, restricts, or modifies any warranty, condition, guarantee, right, remedy, or liability that cannot lawfully be excluded, restricted, modified, or limited under applicable law.
To the extent that any warranty, condition, guarantee, right, remedy, or liability is implied or imposed by applicable law and cannot be excluded, restricted, modified, or limited, DevJet Software’s liability is limited to the maximum extent permitted by applicable law.
Nothing in this EULA excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, death or personal injury, or any other liability to the extent such liability cannot be excluded or limited under applicable law.
18. Disclaimer of Warranty
THE PRODUCT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVJET SOFTWARE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.
DEVJET SOFTWARE DOES NOT WARRANT THAT THE PRODUCT WILL MEET LICENSEE’S REQUIREMENTS, THAT DOCUMENTATION OUTPUT WILL BE COMPLETE OR ERROR-FREE, THAT ALL SOURCE CODE OR COMMENTS WILL BE PARSED CORRECTLY, OR THAT THE PRODUCT WILL BE COMPATIBLE WITH ALL COMPILERS, IDE VERSIONS, PROJECT TYPES, PLATFORMS, BUILD SYSTEMS, OR THIRD-PARTY COMPONENTS.
LICENSEE IS SOLELY RESPONSIBLE FOR REVIEWING, TESTING, VALIDATING, AND BACKING UP CUSTOMER CODE, PROJECT FILES, DOCUMENTATION SOURCE FILES, GENERATED OUTPUT, BUILD CONFIGURATIONS, AND RELEASED DOCUMENTATION.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEVJET SOFTWARE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST BUSINESS, BUSINESS INTERRUPTION, LOSS OF DATA, LOSS OF SOURCE CODE, LOSS OF DOCUMENTATION, LOSS OF GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO THIS EULA OR THE PRODUCT, EVEN IF DEVJET SOFTWARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVJET SOFTWARE’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS EULA OR THE PRODUCT SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY LICENSEE FOR THE PRODUCT DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, WHETHER PAID THROUGH DEVJET SOFTWARE, FASTSPRING, OR ANOTHER AUTHORIZED RESELLER, MERCHANT OF RECORD, OR COMMERCE PROVIDER.
Some jurisdictions do not allow certain exclusions or limitations of liability. In such jurisdictions, DevJet Software’s liability will be limited to the maximum extent permitted by applicable law.
20. Termination
20.1 Termination by Licensee
Licensee may terminate this EULA at any time by uninstalling the Product and destroying all copies of the Product in Licensee’s possession or control.
20.2 Termination by DevJet Software
DevJet Software may terminate this EULA or suspend Licensee’s license if Licensee violates this EULA, fails to pay applicable fees, exceeds license limits, shares license credentials, circumvents license validation, uses the Product for unauthorized third-party services, or otherwise misuses the Product.
20.3 Effect of Termination
Upon termination, Licensee must stop using the Product, uninstall the Product, and destroy all copies of the Product in Licensee’s possession or control.
Termination does not affect provisions that by their nature should survive termination, including restrictions, ownership, intellectual property, warranty disclaimers, limitation of liability, payment obligations, governing law, and dispute-related provisions.
Termination does not require Licensee to remove Documentation Output that was lawfully generated and distributed before termination, unless the Documentation Output was generated or distributed in violation of this EULA or applicable law.
21. Changes to this EULA
DevJet Software may update this EULA from time to time. The updated EULA will be posted on DevJet Software’s website or otherwise made available.
Changes to this EULA apply to future Product versions, future orders, future renewals, and continued use of Product versions released after the updated EULA becomes effective.
Unless required by law or necessary to address abuse, fraud, security, or misuse, changes to this EULA will not retroactively reduce Licensee’s rights to use Product versions lawfully obtained during a paid Subscription Term.
If Licensee does not agree to an updated EULA, Licensee must stop using Product versions governed by the updated EULA.
22. Assignment, Reorganization, and Successor Entity
Licensee may not assign or transfer this EULA, any license seat, or any license rights except as expressly permitted by this EULA or by DevJet Software in writing.
If DevJet Software later incorporates, reorganizes, changes its operating structure, registers or transfers the DocInsight business to a legal entity, or transfers substantially all assets related to DocInsight, DevJet Software may assign or transfer this EULA to the successor operator or legal entity, provided that such transfer does not materially reduce Licensee’s software license rights for Product versions lawfully obtained before the transfer.
Where required by applicable law, DevJet Software will provide notice of the successor operator or legal entity and any related material changes to personal information handling.
23. Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of the Mainland of the People’s Republic of China, without regard to conflict of law principles.
For business, entity, professional, or other non-consumer Licensees, and to the maximum extent permitted by applicable law, any dispute arising out of or relating to this EULA or the Product shall be submitted to the competent courts located in Xiamen, Fujian Province, People’s Republic of China, unless a separate written agreement signed by DevJet Software states otherwise.
Nothing in this EULA limits any non-waivable rights or remedies that a consumer may have under applicable consumer protection laws, including mandatory rights under the law of the consumer’s habitual residence and any right to bring claims in a court or forum that cannot be excluded by agreement.
Nothing in this section prevents DevJet Software from seeking urgent injunctive, equitable, or protective relief in any court of competent jurisdiction for unauthorized use, misuse, infringement, circumvention, or misappropriation involving the Product, license credentials, intellectual property, or confidential information.
24. Severability
If any provision of this EULA is held to be invalid, illegal, or unenforceable, that provision will be modified and interpreted to accomplish the objectives of the provision to the greatest extent possible under applicable law, and the remaining provisions will remain in full force and effect.
25. Entire Agreement
This EULA, together with any applicable order terms, checkout terms, renewal terms, and written license terms provided by DevJet Software, constitutes the entire agreement between Licensee and DevJet Software regarding the Product and supersedes all prior or contemporaneous understandings, agreements, proposals, representations, or communications regarding the Product.
If there is a conflict between this EULA and an order-specific written agreement signed by DevJet Software, the signed written agreement controls for that order.
